{"id":90,"date":"2024-01-19T14:15:59","date_gmt":"2024-01-19T11:15:59","guid":{"rendered":"http:\/\/vneteshop.ru\/?post_type=services&#038;p=90"},"modified":"2024-01-24T13:55:20","modified_gmt":"2024-01-24T10:55:20","slug":"advokat-v-ugolovnom-dele-po-narkotikam","status":"publish","type":"services","link":"https:\/\/legalhelp.by\/en\/services\/advokat-v-ugolovnom-dele-po-narkotikam\/","title":{"rendered":"Drug lawyer"},"content":{"rendered":"<h2>Lawyer under Art. 328 of the Criminal Code of the Republic of Belarus<\/h2>\n<p>The criminal law of Belarus provides for quite severe punishment for drug offenses.<\/p>\n<p>Currently, the Criminal Code of the Republic of Belarus provides for criminal liability on the following grounds:<\/p>\n<ul>\n<li>Art. 327 of the Criminal Code \u201cTheft of narcotic drugs, psychotropic substances, their precursors and analogues\u201d<\/li>\n<li>Art. 328 of the Criminal Code \u201cIllicit trafficking in narcotic drugs, psychotropic substances, their precursors and analogues\u201d<\/li>\n<li>Art. 328-1 of the Criminal Code \u201cIllegal movement across the customs border of the Eurasian Economic Union or the State border of the Republic of Belarus of narcotic drugs, psychotropic substances or their precursors or analogues\u201d<\/li>\n<li>Art. 328-2 \u201cConsumption of narcotic drugs, psychotropic substances or their analogues in a public place or appearing in a public place or being at work in a state caused by the consumption of narcotic drugs, psychotropic substances, their analogues, toxic or other intoxicating substances\u201d<\/li>\n<li>Art. 329 of the Criminal Code \u201cIllegal sowing and (or) cultivation of plants or mushrooms containing narcotic drugs or psychotropic substances\u201d<\/li>\n<li>Art. 330 of the Criminal Code \u201cViolation of the rules for handling narcotic drugs, psychotropic substances, their precursors and analogues\u201d<\/li>\n<li>Art. 331 of the Criminal Code \u201cInducement to use narcotic drugs, psychotropic substances or their analogues\u201d<\/li>\n<li>Art. 332 of the Criminal Code \u201cProviding premises, organizing or maintaining dens for the manufacture, processing and (or) consumption of narcotic drugs, psychotropic substances, their analogues or other intoxicating substances and others\u201d<\/li>\n<\/ul>\n<h2>Drug lawyer<\/h2>\n<p>The timely request for legal assistance in this category of cases is of great importance, since the evidence base begins to form, in addition to the conducted operational investigations, also from the very first explanations of the person, who subsequently acquires the status of a suspect, and subsequently an accused. In practice, there are cases when the basis for a future accusation is formed by information that a person provided during an \u201cinformal, off-the-record\u201d conversation with operational officers.<\/p>\n<p>Our lawyers have more than twenty years of experience in criminal cases under Art. 328 of the Criminal Code and other \u201cnarcotic\u201d articles.<\/p>\n<p>We provide the following legal assistance:<\/p>\n<ul>\n<li>participation in investigative actions as a defense attorney in a criminal case;<\/li>\n<li>participation as a defense attorney during interrogation;<\/li>\n<li>participation as a defense attorney in a confrontation;<\/li>\n<li>preparation of petitions in criminal cases;<\/li>\n<li>appealing the arrest, the applied preventive measure in the form of detention;<\/li>\n<li>visiting the accused in places of detention;<\/li>\n<li>protecting the interests of the accused in court;<\/li>\n<li>preparation of an appeal against a court verdict;<\/li>\n<li>preparation of a complaint by way of supervision against a court verdict;<\/li>\n<\/ul>\n<h2>Responsibility under Art. 328 CC<\/h2>\n<p>The criminal law establishes a rather severe punishment for committing a crime under Art. 328 of the Criminal Code of the Republic of Belarus.<\/p>\n<p><span id=\"79_1\">Illegal <\/span><span id=\"79_2\">without <\/span><span id=\"79_3\">goals <\/span><span id=\"79_4\">sales <\/span><span id=\"79_5\">manufacturing, <\/span><span id=\"79_6\">processing, <\/span><span id=\"79_7\">acquisition, <\/span><span id=\"79_8\">storage, <\/span><span id=\"79_9\">shipping <\/span><span id=\"79_10\">or <\/span><span id=\"79_11\">shipment <\/span><span id=\"79_12\">narcotic <\/span><span id=\"79_13\">funds, <\/span><span id=\"79_14\">psychotropic <\/span><span id=\"79_15\">substances <\/span><span id=\"79_16\">or <\/span><span id=\"79_17\">their <\/span><span id=\"79_18\">precursors <\/span><span id=\"79_19\">or <\/span><span id=\"79_20\">analogues <span id=\"104622_0\">are punished <\/span><span id=\"104622_1\">limitation <\/span><span id=\"104622_2\">freedom <\/span><span id=\"104622_3\">on <\/span><span id=\"104622_4\">term <\/span><span id=\"104622_5\">before <\/span><span id=\"104622_6\">five <\/span><span id=\"104622_7\">years <\/span><span id=\"104622_8\">or <\/span><span id=\"104622_9\">deprivation <\/span><span id=\"104622_10\">freedom <\/span><span id=\"104622_11\">on <\/span><span id=\"104622_12\">term <\/span><span id=\"104622_13\">from <\/span><span id=\"104622_14\">two <\/span><span id=\"104622_15\">before <\/span><span id=\"104622_16\">five <\/span><span id=\"104622_17\">years. The same actions committed for the purpose of selling drugs are punishable\u00a0<\/span><\/span><span id=\"104699_1\">deprivation <\/span><span id=\"104699_2\">freedom <\/span><span id=\"104699_3\">on <\/span><span id=\"104699_4\">term <\/span><span id=\"104699_5\">from <\/span><span id=\"104699_6\">three <\/span><span id=\"104699_7\">before <\/span><span id=\"104699_8\">eight <\/span><span id=\"104699_9\">years <\/span><span id=\"104699_10\">with <\/span><span id=\"104699_11\">fine <\/span><span id=\"104699_12\">or <\/span><span id=\"104699_13\">without <\/span><span id=\"104699_14\">fine\u00a0<\/span><\/p>\n<p>A special category of cases are criminal cases under Part 3 of Art. 328 of the Criminal Code of the Republic of Belarus, which, among other things, provides for liability for the sale of drugs by a group of persons.
