Despite the changing epidemiological situation, the Republic of Belarus remains an attractive jurisdiction for foreign business.
Thanks to the reform of migration legislation, foreign citizens who arrived in Belarus through the Minsk National Airport were given the opportunity to enter the country visa-free. However, this entry regime applies primarily to persons who arrived in Belarus for tourism purposes, and the period of stay cannot exceed 30 days from the date of entry. You must also leave the Republic of Belarus through the Minsk National Airport. If a person is interested in organizing a business in Belarus, then, as a rule, the period of his stay cannot be limited to 30 days. For this reason, the migration legislation of Belarus provides for other regimes for the stay of foreigners in the country.
Temporary residence permit in Belarus (TRP)
Grounds for temporary residence permit in Belarus
A temporary residence permit in Belarus is issued to foreigners on the following grounds:
- the person arrived in Belarus to study;
- the foreigner is a spouse or close relative of a citizen of the Republic of Belarus who permanently resides in Belarus;
- a foreign citizen arrived in Belarus to engage in labor or entrepreneurial activities;
- the foreigner is a highly qualified worker within the meaning of the legislation of the Republic of Belarus;
- a foreign citizen has the right of ownership of residential premises in the Republic of Belarus;
- the foreigner arrived to receive medical care in a hospital setting, or is accompanied by a person who arrived in Belarus for these purposes.
Please note that this list of reasons is not exhaustive. At the same time, the most common request for a temporary residence permit is related to the fact that a foreign citizen plans to carry out business activities in Belarus, or work for a Belarusian employer under an employment contract.
Duration of temporary residence permit in Belarus
As a general rule, the period of temporary residence permit in Belarus does not exceed one year from the date of its issuance. From the point of view of the migration legislation of Belarus, a foreigner must leave the country after the expiration of the period for which the temporary residence permit was issued, or obtain a new permit for temporary residence in Belarus. It is not possible to extend the validity period of an issued temporary residence permit in Belarus.
How to obtain a temporary residence permit in Belarus
To obtain a temporary residence permit in Belarus, a foreign citizen must prepare and submit a package of documents established by law to the citizenship and migration authorities of Belarus. The period for obtaining a temporary residence permit, as a general rule, is 15 days. Work permit in Belarus
One of the grounds for obtaining a temporary residence permit in Belarus is employment. A document confirming the right to work for a Belarusian employer is a special work permit, which is issued taking into account the conclusion of the labor, employment and social protection authority. A work permit is issued for a period of one year, after which the employer must again submit an appropriate application to the government authorities if the foreign citizen continues to work for him. Please note that a number of foreigners do not need a work permit in Belarus. For example, on the territory of the EAEU equal conditions have been created for citizens of Belarus, Armenia, the Kyrgyz Republic, Russia and Kazakhstan. Therefore, for citizens of these states, Belarusian employers are not required to obtain special permits. In addition, there are exceptions for residents of the Hi-Tech Park. If an employer who is a HTP resident has a need to attract foreign labor, then a work permit does not need to be obtained, regardless of which country the future employee is from.
Residence permit in Belarus
A residence permit or permanent residence permit in Belarus is issued to foreigners who have a close connection with the country. For example, ppermission on permanent accommodation issued foreigners, which:
